In order to advertise your listing in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™, you must agree to the following:

The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ Terms and Conditions

  1. INTRODUCTION
    1. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ is owned and operated by Combined L.A./Westside Multiple Listing Service, Inc. (“The MLS®”), and is provided to users (including without limitation advertisers and advertising agencies) (“you” or “User”) under the terms and conditions of this “The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ Service Agreement” (the “Agreement”), which may be amended or modified from time to time by Publisher without notice.
    2. By placing an Insertion Order in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™, using its Website, or using any service provided by The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , User agrees to this Agreement and represents and warrants that User has provided and will provide true, accurate, current, and complete information in User’s registration at The MLS Open House Guide ™ (Broker & Weekend Editions) and in all advertising and other information submitted to The MLS Open House Guide ™ (Broker & Weekend Editions) ; will comply with all Terms of Use as set forth in this Agreement and elsewhere on this Website; and will be bound by all terms and conditions hereof and thereof.
  2. DESCRIPTION OF SERVICE
    1. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ is a fee-based service provided by Combined L.A./Westside Multiple Listing Service, Inc. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ is available only to licensed real estate brokers and salespersons who are Members of The MLS® to market available properties to other licensed real estate brokers and salespersons. Publisher reserves the right, in its sole discretion, to restrict from time to time the terms and conditions of the Service and the types of information that may be included.
  3. USER ACCOUNT, PASSWORD, SECURITY
    1. Users are responsible for maintaining the confidentiality of their User ID and password. Each User agrees to be fully responsible for all activities that occur under such User ID and password. In the event a User discovers unauthorized access to or use of such User ID or password, the User must notify The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ immediately. Each User is authorized to make use of only the User ID and password assigned to such User, and solely for purposes authorized by The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ . Users who violate this Agreement or Rules and Regulations or other policies posted on www.TheMLS.com are subject to have their service suspended or revoked.
  4. PAYMENT TERMS
    1. Advertisers and advertising agencies agree to pay the applicable fee due based on the ad type and number of insertions purchased, according to The MLS Open House Guide™ ’s (Broker & Weekend Editions) then current rate card. The MLS Open House Guide’s™ (Broker & Weekend Editions) preferred method of payment is by credit card (Visa, MasterCard, and American Express) which will immediately be charged the total due. Checks submitted will be processed as electronic checks in accordance with current banking practices. Users represent that all payment information furnished is accurate, that the specified credit card or checking account has immediately available funds for the total due. Unless otherwise agreed by The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , all fees are non-refundable. Credits purchased for advertising insertions must be used for the ad type purchased. If an ad is placed and then withdrawn prior to the deadline for that publication date, the insertion credit may be used toward an insertion in a future publication date of the same ad type.
  5. LIMITATION ON PUBLISHER'S LIABILITY
    1. Publisher offers, subject to the terms and conditions herein, to accept insertion orders for advertising to be published in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ . By tendering any advertising order, insertion, or, space contract or other similar order (collectively, “Insertion Order”), advertisers and advertising agencies agree to indemnify and hold Publisher, its employees, agents, contractors, and subcontractors (collectively, “Indemnitees”) free and harmless from any expenses, damages and costs (including reasonable attorneys' fees) resulting from Publisher’s compliance with such Insertion Orders (including without limitation from claims of defamation, libel, slander, violation of privacy, copyright infringement, trademark infringement, or otherwise). In connection therewith, Publisher shall have the right to settle any such claim and to control any litigation or arbitration as to which any Indemnitee may be party all at the cost of the agency or advertiser who placed such Insertion Order. Advertiser and advertising agency, if applicable, shall be jointly and severally liable under this indemnity. Advertising agency, if applicable, warrants that it is authorized to bind, and does bind, advertiser to such indemnity jointly and severally with the advertising agency.
    2. In no event shall Publisher’s liability for any act or omission in connection with any insertion or advertisement, regardless of the circumstances, exceed the fee paid for such insertion or advertisement.
    3. Publisher reserves the right, in its sole discretion, with or without notice, to reject any Insertion Order, or to defer or cancel the printing, publication, or circulation of any publication date, or to discontinue publication at any time, and shall not be held liable for any failure to print, publish, or circulate all or any portion of the tendered advertising. Publisher’s sole obligation in such event shall be either to publish the tendered advertising in the next available publication date, or to refund the proportional price of the insertion which was not published, in Publisher’s sole discretion.
    4. Without limiting the foregoing, Publisher shall not be liable or responsible for any errors, omissions, or non-insertions of advertising, whether due to labor or contractor disputes involving Publisher, its employees, agents, contractors or subcontractors, transportation delays or embargoes, or any circumstances beyond Publisher’s control.
    5. Publisher reserves the right to accept or reject or omit any advertising for any reason.
    6. The terms and conditions of this Agreement shall be deemed incorporated in every Insertion Order tendered to The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , in any form or format, whether or not specifically referred to therein, unless modified by written agreement containing the manual signature of Publisher’s Chief Executive Officer. No other person has any authority to vary the terms and conditions of this Agreement. By this reference, this Agreement shall supersede any inconsistent statements in any Insertion Order.
    7. PUBLISHER MAY MODIFY THIS AGREEMENT BY POSTING NOTICE THEREOF ON ITS WEBSITE. ANY SUCH MODIFICATION SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING UNLESS A DIFFERENT EFFECTIVE DATE IS SPECIFIED IN SUCH NOTICE.
    8. PUBLISHER SHALL NOT BE BOUND BY ANY TERMS OR CONDITIONS, WHETHER PRINTED, HANDWRITTEN, OR OTHERWISE, ON INSERTION ORDERS, CONTRACTS, ORDER BLANKS, OR INSTRUCTIONS WHEN SUCH TERMS OR CONDITIONS CONFLICT WITH THIS AGREEMENT OR PUBLISHER’S POLICIES, INCLUDING SUCH POLICIES APPEARING ON PUBLISHER’S WEBSITE.
  6. MLS RULES AND REGULATIONS ALSO APPLICABLE
    1. To the extent applicable, the MLS Rules and Regulations of the Combined L.A./Westside MLS, Inc. (“MLS Rules and Regulations”), shall be applicable to all Insertion Orders and advertising in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ and are hereby incorporated in this Agreement by this reference.
    2. Without limiting the generality of the foregoing, the attention of advertisers and advertising agencies is drawn to the following specific provisions of the MLS Rules and Regulations, the full text of which (and all provisions of the MLS Rules and Regulations) should be consulted at www.themls.com.
      1. Rule 7.5: Mandatory Submission. In general, all residential properties (regardless of number of units) and vacant lots in the service area of The MLS® for which a Participant/Subscriber has a listing must be inputted into The MLS® within 48 hours (excepting weekends, holidays, and postal holidays) after all necessary signatures of the seller(s) are obtained. Insertion of a listing in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ is not a substitute for submission of the listing to The MLS®. [This is only a summary; the text of Rule 7.5 should be read for further information.]
      2. Rule 7.6: Exempted Listings. If the seller refuses to permit a listing to be placed in The MLS®, within 48 hours after the listing is taken (excepting weekends, holidays, and postal holidays) the Listing Broker shall submit to The MLS® a certification signed by the seller that the seller does not authorize the listing to be placed in The MLS®. [This is only a summary; the text of Rule 7.6 should be read for further information.] If a property is an Exempted Listing, the property cannot be placed in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ unless the seller removes the exemption and permits the listing to be placed in The MLS®.
      3. Rule 8.2: Written Documentation. Listing Brokers filing listings with The MLS® shall have a written listing agreement with all necessary signatures in their possession. Only listings that create an agency relationship between the seller and the Broker Participant are eligible for submission to The MLS®. By submitting a listing to The MLS®, Participants and Subscribers represent that they have in their possession such written agreements establishing agency and the represented type of listing agreement. The MLS® may at any time demand a copy of (a) any such written listing agreement to verify the listing's existence and adequacy, and (b) seller's written authorization required under these rules. If the Participant or Subscriber fails to provide documentation requested by The MLS® within 48 hours (excepting weekends, holidays, and postal holidays), The MLS® shall have the right to withdraw immediately any listings placed in The MLS® by the Participant and/or Subscriber in addition to disciplining the Participant and Subscriber for violating the Rules and Regulations of The MLS®.       4. Rule 12.5: Misuse of Remarks and Graphics. Participants and Subscribers in The MLS® may not use the remarks and graphics in a property data profile sheet or listing submitted to The MLS® for purposes of disparaging other real estate agents or conveying information about other offices or for conveying any other information that does not directly relate to the marketing of the listing. Remarks and graphics cannot reference names, telephone/facsimile numbers, e-mail addresses, any type of Website addresses such as property, personal, and/or company addresses, price range, and any lockbox/security code information. [This is only a summary; the text of Rule 12.5 should be read for further information.]
    3. Requirements for Advertising Properties in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ . Prior to placing an ad for a property in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , a Participant, Subscriber, or Reciprocal Member must have complied with Rules 7.5, 7.6 and 8.2. For Sale By Owner and pocket listings cannot be advertised in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ . Reciprocal Members placing an ad for a property in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ must submit the listing into The MLS® within 48 (excepting weekends, holidays, and postal holidays) hours after the listing contract is signed by all sellers, or prior to placing the ad in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ if more than 48 hours (excepting weekends, holidays, and postal holidays) have passed.
  7. INSERTION ORDERS AND REVISIONS
    1. All changes in advertising copy must be made in writing by the applicable deadline. Publisher cannot assure insertion of late arriving Insertion Orders or advertising changes.
    2. Publisher reserves the right to reject any Insertion Order for any reason, including because such Insertion Order or change is not in compliance with The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ policy or publication standards, including any requirements that are incorporated herein by reference, in Publisher’s sole discretion.
  8. PRICING
    1. All prices are subject to change from time to time in Publisher’s discretion. Prices, when changed, will be reflected in Publisher’s rate card.
    2. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ reserves the right to re-price insertions if fewer than the number of insertions that are contracted for are used within a 12-month period.
  9. PAYMENT TERMS
    1. All charges are due in U.S. funds drawn on a U.S. bank. Publisher looks to the advertising agency placing the Insertion Order, if applicable, for payment; however, the advertiser and the advertising agency shall be jointly and severally liable for payment of all sums due to Publisher. Advertising agency warrants, by submitting an Insertion Order, that the advertiser and the advertising agency have accepted such joint and several liability. Cancellations will not entitle advertisers or advertising agencies to refund of any fees paid.
    2. Advertisers and advertising agencies may contact The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ Production Department for mechanical specifications, printing requirements, and shipping instructions for supplied inserts.
  10. DISCLAIMER OF WARRANTIES AND LIABILITIES; LIMITATION ON CLAIMS AND DISPUTES; JURISDICTION AND VENUE
    1. The Service is provided without warranty of any kind, express or implied, to the maximum extent permitted by law. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , The MLS®, their affiliates, their respective officers, directors, managers, employees, contractors, and agents (“MLS® Open House Guide Parties”) do not guarantee, warrantee, promote, endorse nor shall they be held responsible for any listing including any information or its presentation, or any property or service offered, including their accuracy, currentness, content, quality, copyright, compliance, or legality.
    2. Without limiting the generality of the foregoing, The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ Parties make no warranty to any person that (i) the Service will meet any User’s requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the Service will be accurate or reliable, (iv) the quality of any product, service, information, or other materials advertised in or obtained by any person through the Service will meet such person’s expectations or requirements.
    3. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ does not investigate, represent, or endorse the accuracy, legality, legitimacy, validity, reliability, licensing requirements, other compliance, or quality of any information, advertising, or offer, whether in paper, electronic, or other form, which may appear in or be accessed, linked, downloaded, or obtained from or through The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , or of any product or service purchased, provided, or obtained as a result of an advertisement or other information contained therein.
    4. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ does not investigate or assume responsibility for enforcing licensing requirements or other compliance with respect to licensed professions or trades when publishing advertisements.
    5. All products, services, or promotions advertised in The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ , including, without limitation, the prices and availability of any product or service or any feature thereof, is subject to change at any time, without notice, by the advertiser.
    6. Publisher reserves the right, in its sole discretion, without notice, to make modifications to any portion of the Service.
    7. Each User and advertiser acknowledges and agrees that in no event shall The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ . Parties be liable to User or any other person or entity for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, whether resulting from: (i) the use or inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or information received or transactions entered into through, from, in connection with, or as a result of the Service; (iii) unauthorized access to or alteration of User’s data or account; (iv) statements or conduct of any third party concerning the Service or this Agreement; or (v) any other matter relating to the Service.
    8. ANY CLAIM OR DISPUTE ARISING FROM OR RELATED IN ANY WAY TO THIS AGREEMENT OR THE SERVICE SHALL BE DETERMINED EXCLUSIVELY BY LEGAL ACTION FILED AND MAINTAINED EXCLUSIVELY IN A COURT OF COMPETENT JURISDICTION SITUATED IN LOS ANGELES COUNTY, CALIFORNIA .
  11. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ PROPRIETARY RIGHTS; COPYRIGHT; INTELLECTUAL PROPERTY RIGHTS
    1. Users acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Without limitation, Users further acknowledge and agree that (i) content, advertisements, or information presented through the Service may be protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws, (ii) Users do not acquire any rights in or to any such proprietary rights, and (iii) Users will comply with and respect such proprietary rights. Except as expressly authorized in writing by The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ or specific advertisers, Users agree not to modify, rent, lease, loan, sell, distribute, or create derivates based on the Service, or any information or advertisement appearing therein, in whole or in part. The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ respects the intellectual property rights of others and we ask and expect Users to do the same.
  12. FAIR HOUSING COMPLIANCE
    1. Advertised real estate is subject to the Federal Fair Housing Act of 1968, as amended, and all other applicable federal, State, and local fair housing laws. Dwellings advertised are available on an equal opportunity basis.
    2. Users are cautioned to adhere to HUD guidelines regarding the use of objectionable or unlawful terminology in placing advertising. Examples may be found at: www.fairhousing.com/legal_research/regs/fhr_109-20.html .

      1. We provide such information to our subsidiaries, affiliated companies or other trusted third parties in order to process transaction information on our behalf.

We may decline to process requests that we consider unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or for which access is not otherwise required.
  7. Enforcement
    1. Please feel free to contact us if you have any questions or concerns regarding this Privacy Policy or The MLS Open House Guide’s™ (Broker & Weekend Editions) treatment of personal information by contacting us through www.TheMLS.com. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between The MLS Open House Guide™ Broker Edition & The MLS Weekend Homes & Open Houses™ and an individual.
